KOMISI Pemberantasan Korupsi (KPK) menetapkan WH selaku Ketua Pengurus Yayasan Rumah Sakit SKM sebagai tersangka dalam dugaan tindak pidana korupsi berupa suap pengurusan perkara di Mahkamah Agung (MA).
Selanjutnya, KPK melakukan penahanan terhadap tersangka WH untuk 20 hari pertama terhitung mulai 17 Februari sampai 8 Maret 2023. Penahanan dilakukan di Rutan KPK Pomdam Jaya Guntur.
Dari perkara yang bermula dari kegiatan tangkap tangan ini, KPK sebelumnya telah menetapkan 14 orang lainnya sebagai tersangka, yaitu SD dan GS, hakim agung MA; PN Hakim Yustisial/Panitera Pengganti pada Kamar Pidana MA dan Asisten Hakim Agung GS; EW dan ETP Hakim Yustisial/Panitera Pengganti MA; RN dan NA selaku PNS MA; DY dan MH PNS pada Kepaniteraan MA.
“Dalam konstruksi perkara ini, WH selaku Ketua Pengurus Yayasan Rumah Sakit SKM sebagai perwakilan pihak termohon dalam gugatan penundaan kewajiban pembayaran utang (PKPU) yang diajukan PT MHJ selaku pihak pemohon di Pengadilan Negeri Makassar. Majelis hakim memutus Yayasan Rumah Sakit SKM dinyatakan pailit dengan segala akibat hukumnya,” kata Juru Bicara Bidang Penindakan dan Kelembagaan Ali Fikri dalam rilisnya, Senin (20/2).
Ali mengatakan Yayasan Rumah Sakit SKM kemudian mengajukan kasasi ke MA agar putusan di tingkat pertama ditolak dan tidak dinyatakan pailit. WH lalu berinisiatif menyiapkan sejumlah uang dan berkomunikasi dengan MH dan AB selaku PNS pada MA untuk mengawal proses kasasi perkara ini dengan EW sebagai panitera penggantinya.
“Sebagai komitmen tanda jadi, WH diduga memberikan sejumlah uang kepada EW secara bertahap hingga mencapai sekitar Rp3,7 miliar,” ujar Ali.
Penerimaan dilakukan melalui MH dan AB sebagai perwakilan sekaligus orang kepercayaannya. Penyerahan uang dilakukan saat proses kasasi berlangsung yang diduga untuk memengaruhi isi putusan.
“Setelah uang diberikan, putusan kasasi yang diinginkan WH dikabulkan dan Rumah Sakit SKM tidak dinyatakan pailit,” ungkap Ali.
Atas perbuatannya, tersangka WH disangkakan melanggar Pasal 5 ayat 1 huruf a atau b atau Pasal 13 atau Pasal 6 ayat 1 huruf a UU RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan UU RI Nomor 20 Tahun 2001 tentang Perubahan atas UU RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi.
