KEMENTERIAN Perdagangan melalui Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti) terus berinovasi mengikuti perkembangan perdagangan pasar fisik aset kripto.
Hal ini ditandai dengan diterbitkannya Peraturan Badan Pengawas Perdagangan Berjangka Komoditi (Perba) Nomor 11 Tahun 2022 tentang Penetapan Daftar Aset Kripto yang Diperdagangkan di Pasar Fisik Aset Kripto. Peraturan ini sekaligus mencabut Peraturan Bappebti Nomor 7 Tahun 2020.
“Terbitnya Perba ini untuk mengakomodir kebutuhan para calon pedagang aset kripto, termasuk industri aset kripto di Indonesia. Hal ini sesuai dengan pertumbuhan data jumlah pelanggan dan volume transaksi aset kripto yang terus meningkat, serta jenis aset kripto yang terus bertambah,” jelas Plt. Kepala Bappebti Didid Noordiatmoko, Jakarta (9/8).
Didid menyampaikan, dalam Perba tersebut ditetapkan sebanyak 383 jenis aset kripto yang dapat diperdagangkan di pasar fisik aset kripto. Sedangkan, untuk jenis aset kripto di luar daftar tersebut, wajib dilakukan delisting oleh calon pedagang fisik aset kripto dengan diikuti langkah penyelesaian bagi setiap pelanggan aset kripto.
Sebelumnya, sesuai Peraturan Bappebti Nomor 7 Tahun 2020, jenis aset kripto yang diperdagangkan berjumlah 229 jenis. Namun, karena adanya usulan dari pelaku pasar dan berdasarkan evaluasi Bappebti, serta meningkatnya pertumbuhan transaksi aset kripto, maka daftar aset kripto yang diperdagangkan diusulkan untuk disesuaikan. Baik sesuai dengan kebutuhan dan perkembangan blockchain secara global atau dengan melakukan delisting jenis aset kripto berdasarkan metode penilaian Analytical Hierarchy Process(AHP).
“Hal tersebut dilakukan untuk memberikan kepastian hukum agar masyarakat yang akan berinvestasi mendapatkan informasi dan panduan yang jelas atas setiap jenis aset kripto yang diperdagangkan,” terang Didid.
Perba ini mengadopsi pendekatan positive list yang bertujuan untuk memperkecil risiko diperdagangkannya jenis aset kripto yang tidak memiliki kejelasan whitepaper atau yang memiliki tujuan ilegal seperti pencucian uang dan sebagainya.
Kepala Biro Peraturan Perundang-Undangan dan Penindakan Bappebti Aldison menambahkan, Perbaini mengatur tata cara, persyaratan, serta mekanisme penambahan dan pengurangan jenis aset kripto dalam daftar aset kripto yang diperdagangkan.
“Hal tersebut antara lain dengan mempertimbangkan prinsip umum untuk aset kripto yang dapat diperdagangkan, seperti berbasis distributed ledger technologydan lulus hasil penilaian denganmetode AHP. Tentunya turut mempertimbangkan nilai kapitalisasi pasaraset kripto, nilai risikonya, manfaat ekonominya, serta apakahtelah masuk dalam transaksi bursa aset kripto besar dunia,” imbuh Aldison.
Perba ini juga melakukan efisiensi terhadap tatacara pengusulan aset kriptoyang diperdagangkan selama Bursa Berjangka Aset Kripto belum terbentuk.
Dengan terbitnya Perba ini, penilaian pengusulan aset kripto dilakukan oleh Tim Penilaian Daftar Aset Kripto yang beranggotakan unsur-unsur dari Bappebti, asosiasi, dan pelaku usaha. Sehingga, proses penilaian akan lebih cepat dan akurat.
Selain itu, untuk memberikan kepastian hukum, calon pedagang fisik aset kriptoyang akan melakukan listing atau delisting jenis aset kripto yang telah ditetapkan, wajib terlebih dahulu menyampaikan pemberitahuan secara tertulis kepada Kepala Bappebti.
“Dengan diterbitkannya Perba ini, diharapkan dapat memberikan kepastian hukum sekaligus perlindungan bagi masyarakat dalam bertransaksi di pasar fisik aset kripto,”pungkas Aldison.(*ls/Dag/Ded)
